By accepting an estimate, placing an order, or making payment, the Clinic agrees to the following Terms and Conditions:

1About BenGait Labs

BenGait Labs Private Limited ("BenGait Labs") is a digital Orthotics & Prosthetics (O&P) OEM providing design, engineering, and manufacturing services using 3D scanning, AI-assisted design, and additive manufacturing. These Terms govern all B2B transactions with clinics, hospitals, and professional partners.

2Definitions

  • BenGait Labs: BenGait Labs Private Limited
  • Clinic / Partner: Any hospital, clinic, laboratory, or professional entity placing orders with BenGait Labs
  • Patient: End user assessed and managed by the Clinic
  • O&P: Orthotics and Prosthetics
  • BenX: BenGait Labs' digital design, order, and workflow platform

3Scope & Acceptance

These Terms apply to:

  • Use of the BenX platform
  • Submission of patient data, scans, and assessments
  • Acceptance of estimates and placement of orders
  • Completion of payments

Any of the above actions constitutes unconditional acceptance of these Terms.

4Professional Responsibility of the Clinic

  • The Clinic remains solely responsible for patient assessment, prescription, clinical decision-making, fitment, alignment, and final delivery to the patient.
  • BenGait Labs acts strictly as a design and manufacturing partner (OEM) and does not provide medical advice or clinical services.
  • The Clinic confirms that all submissions are made by qualified professionals in accordance with applicable laws and professional standards.

5Platform Access & Data Responsibility

  • Clinics accessing BenX are responsible for safeguarding login credentials and data security.
  • The Clinic confirms that it has obtained all necessary patient consents for sharing data with BenGait Labs.
  • BenGait Labs shall not be liable for errors arising from incorrect, incomplete, or inaccurate data submitted by the Clinic.

6Ordering, Design Approval & Payment

  • All designs are created strictly based on inputs, scans, and instructions provided by the Clinic.
  • The Clinic must review and approve designs before manufacturing.
  • All payments are non-refundable, as products are custom-made and patient-specific.
  • Acceptance, modification, or rejection of any order remains at the sole discretion of BenGait Labs.

7Product Specifications & Limitations

  • Product images, descriptions, and specifications are indicative and may vary due to customization, material behavior, or manufacturing constraints.
  • BenGait Labs does not guarantee clinical outcomes, patient satisfaction, or long-term performance, as these depend on clinical application and usage.

8Shipping & Delivery

  • Shipping timelines are provided on a best-effort basis.
  • BenGait Labs shall not be liable for delays caused by logistics partners, customs, force majeure events, or other third-party factors.
  • Any damage or defect must be reported within 24 hours of receipt with supporting evidence to hello@bengaitlabs.com.
  • Failure to report within this period shall release BenGait Labs from all related obligations.

9Returns & Refunds

Returns and refunds, if applicable, shall be governed strictly by the Refund Policy available at:

10Intellectual Property

  • All designs, workflows, software, processes, and content associated with BenX and BenGait Labs are the exclusive intellectual property of BenGait Labs.
  • The Clinic shall not copy, replicate, reverse engineer, or commercially exploit any part of the platform or workflow without written consent.
  • Third-party trademarks remain the property of their respective owners.

11Limitation of Liability & Indemnity

BenGait Labs shall not be liable for indirect, incidental, consequential, or patient-related damages.

The Clinic agrees to indemnify and hold harmless BenGait Labs from any claims, losses, liabilities, or legal actions arising from:

  • Clinical decisions
  • Improper fitment or usage
  • Patient dissatisfaction
  • Non-compliance with applicable regulations

12Force Majeure

BenGait Labs shall not be liable for failure or delay caused by events beyond reasonable control, including natural disasters, war, government actions, labor disturbances, power failures, or internet disruptions. Obligations shall remain suspended for the duration of such events.

13Modification of Terms

BenGait Labs reserves the right to amend these Terms at any time. Revised Terms shall be effective immediately and apply to all current and future transactions.

14Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. All disputes shall be subject exclusively to the jurisdiction of the courts at Noida, India.
